Angered by a Recalcitrant Best Western Kuta, Bali Officials Prepare Criminal Charges and Plans to Tear Down the Hotel.

NusaBali reveals that the Badung regency administration is preparing for a full-on legal confrontation with the Best Western Kuta by convening an ad hoc legal team comprised of top local lawyers  Suryatin Lijaya, Nyoman Putra, Suryadharma and Sugiarta, together with representatives of the Attorney General’s office in Denpasar.

The top-class legal team convened at a lengthy meeting held at the Badung Regency Office on Friday, May 20, 2011, led directly by the regent, A.A. Gde Agung.

"At the meeting, the Bupati (editor: regent) appointed the legal team that will take the next steps in handling the violations committed by The Best Western. That will include reporting the violations by the Best Western Hotel to the police," said Ketut Martha, the head of the regency’s enforcement team (Satpol Pamong Praja Badung).

Martha confirmed that newly established legal team is itemizing the many legal violations of the Best Western Kuta that will form the basis of eventual criminal charges. In addition, the Badung administration is commencing the legal steps to lead to the 111-room hotel being torn down.

"Their building has absolutely no permission, so we will report it for destruction. That will happen with a decision that will be made following our report to the police," Martha explained.

Similar sentiments were sounded by the head of the Legal and Human Rights division of the Badung regency, Komang Budhi Argawa. Commenting separately, Argawa told the press that the regent was firm in calling for the case against the hotel to proceed as quickly as possible, demanding that there be concrete action in the coming week.

Among the criminal charges to be laid against the Best Western Kuta will be for interference with the official sealing sign placed in front of the hotel by the regency and covered with a white sheet, supposedly by the hotel’s owner.

Further investigations have revealed that the named on tax documents filed on behalf of the Best Western Hotel show PT Bambu Indah Timur as the registered owners of the hotel under the name of Iwanto Hartojo, residing at Jalan Raya Jatinegara No. 43 in East Jakarta.

Strangely, these documents make no mention of Wayan Wijana who has presented himself as the owner of the hotel in dealings with both regency officials and the press.
