Bali Provincial Authorites Going Head to Head with Badung Officials on Who Controls Zoning in Nusa Dua

The problem of the Beach World Complex at Nusa Dua remains at a bureaucratic impasse. The restaurant, spa and entertainment complex nearing completion and located just 45-meters from the shore line is, according the Badung regency officials, legal based on permits issued by their office. Meanwhile, the provincial government of Bali insists the complex violates provincial zoning laws and must be removed and located a minimum  100-meters from the shore. Adding yet another chorus to the ongoing polemic, local citizens in Nusa Dua are claiming the new structure will impede beach access for the public, a right guaranteed under provincial zoning laws.

The provincial government has issued two formal written warnings to the Beach World Complex project advising them to cease constructions. The third warning, thought to be imminent, is usually  a final warning prior to a forced evacuation of the site and possible demolition by local enforcement officials.

According to NusaBali, on Friday, May 27, 2011, a number of officials from the Bali provincial government called on the Badung regent's office for a closed meeting. Following that meeting, all the participants refused comment to the press regarding the results of their deliberations, preferring to tell the press that the purpose of the meeting was for coordination purposes only.

The press did quote the spokesman for the Badung regency, I Wayan Wede Dharmajaya, as saying that the regency and the province had yet to arrive at a common understanding and agreement on the zoning problems at the Beach World Complex.

The position of the province of Bali remains constant, insisting that provincial zoning laws have precedence over regency rules; the regency permits allowing the Beach World Complex to build within 45 meters of the seashore are in violation of the 100 meter setback rules in the provincial zoning laws of 2007 and 2009; and that any regency official having issued building permits that contradict the provincial rules can face 5 years in prison.

Nusa Bali described the May 27, 2011, meeting between provincial and regency officials as "tense."
