As reported by BeritaBali.com, a Team to Supervise and Coordinate Provincial Development (TP3), led by the Provincial Secretary, Dewa Made Indra, has delivered a written reprimand to the Director of PT Pantai Semara Nusantara in its capacity as manager of the massive Finns Beach Club located on Berawa Beach in North Kuta, Bali.
The reprimand represents the follow-up to a case revolving around a Sunday, 13 October 2024 incident in which Finns Beach Club held a festive beachside fireworks display that was seen to disturb local religious ceremonies.
At the time, public and social media were awash with coverage of the incident, evoking strong reactions from several sectors of Balinese society who saw the Club’s actions as emblematic of broader neglect and disregard paid generally to Balinese culture.
The formal written reprimand (Β.27.500.13/6238/IZIN/DPMPTSP) dated 22 November 2024, signed by the chairman of the TP3, Dewa Made Indra, and listed several specific infractions of local rules allegedly committed by Finns Beach Club.
The violations listed in the reprimand letter:
- The Finns Beach Club management is accused of failing to respect a traditional ceremony and, in the process, disrupting a Hindu ritual by the discharge of fireworks. The letter explained that these actions disrupted public order and wounded the feelings of most Balinese.
- The launching of fireworks performed daily between 7:00 – 10:00 pm from 19 May until 15 October 2024 was not in accordance with Bali’s concept of “cultural tourism.”
- The Club’s Management was not authorized to use a public beach area for their “private” firework displays.
- Finns Beach Club has failed to renew and comply with the official Confirmation of Land Use Following Zoning Rules (KKKPR), which has resulted in improper and illegal land use, including the bamboo construction of The Flippas Restaurant that stands illegally in an official green zone (Ruang Terbuka Hijau – RTH 2).
- The drawings and schematics for the official building permit (IMB) issued for Finns Beach Club in 2016 do not conform with the existing building structures. Finns Beach Club has allegedly not met its legal obligations as regards the Building Permit (Persetujuaan Bangunan Gedung – PBG) and the issuance of a Building Use Permit (SLF).
- Finns Beach Club also does not hold an environmental permit (persetujuan lingkunan) that conforms to the actual nature of their business activity or a proper restaurant permit. The current restaurant permit stipulates seating for only 200 diners when, in fact, the restaurant operates with seating for 500 diners.
Because of the violations and infractions listed, the TP3 for the Province of Bali reminded the management of Finns Beach Club to honor and respect local Balinese customs, culture, and religious practices in how they operate their business. The managers of Finns Beach Club have been told to fulfill and meet all the documentation requirements provided for under the law within the coming 60 days.
The management of the Finns Beach Club has been ordered to file a written report upon the completion of each unfulfilled operating permit or other license requirement to the chairman of the TP3. The Club has also been warned that a failure to follow the rules and get its documentation in order means the Company will face further enforcement measures and penalties under the law.
