Is Bali-KTP Requirement for Online Drivers Constitutional?

Online motorcycle taxis and taxi drivers strongly object to proposals to make possessing a Balil identity card (KTP) mandatory for only transportation drives working on the Island.

Online drivers and their umbrella professional organizations threaten to file legal actions if the plan requiring Bali KTPs for drivers goes ahead. 

The chairman of the Bali Online Transport Association (PTOB), Aryanto, is adamant that the current regulation requiring a domicile letter is already sufficient as a requirement to register to work as an online driver. He refers to the requirements in Gubernatorial Regulation (Pergub) Number 40 of 2019 covering Application-Based Special Rental Transportation Services in Bali and the Minister of Transportation Number 118 of 2019 Regulation.

“I reject the KTP requirement, and as the chairman of the PTOB (Bali Online Transport Association), I will file a class action lawsuit against the government for issuing the regulation,” said Aryanto, quoted by detikBali.com. 

Aryanto demands that no difference be made in the treatment applied between online drivers who are native Balinese and non-Balinese immigrants. Bali Governor Regulation Number 40 only requires a domicile certificate, and he thinks that should not be changed. “A domicile certificate does not require a Balinese ID card. If it is changed, constitutional rights are being curtailed,” added Aryanto

For Aryanto, the working rights of immigrant online drivers can be threatened if there is a requirement to have a Balinese ID card as a requirement to become an online vehicle driver. He insists such a move would be unfair.

“I am not highlighting the business issue, but I am talking about the constitutional rights of citizens for justice and equality in earning a living,” said Aryanto.

Online transportation and Bali tourism drivers are presently at odds. The Bali Tourism Driver Association and their tourism drivers who joined the Bali Tourism Driver Struggle Forum (FPDP) demand eliminating the domicile letter rule in favor of requiring a Bali-KTP as a requirement to register to work as an online taxi driver. In addition, they proposed limiting the quota of online taxi cars in Bali, regulating and reorganizing the existence of special rental transportation vendors and motorbike rentals, and standardizing rates for rental transportation.

Meanwhile, Bali DPRD Chairman Dewa Made Mahayadnya said that online or conventional transportation would be regulated through regional regulations (perda) promulgated after the elected governor is inaugurated in February.

“The Perda has begun to be discussed through the Regional Regulation Formation Agency ( Bapemperda), with a final decision by the new governor awaited,” said Dewa Mahayadnya on Monday, 21 January 2025.
