Indonesian Excursion Boat Captain to be Charged with Negligent Homicide in the September 2019 Death of a South African and Brazilian Tourist

Captain Subahak, The Skipper of the speed boat Nagasima-Go that capsized at Devil’s Tear at Nusa Penida on Monday, September 16, 2019, resulting in the drowning death of Brazilian Caval Heir O’Biron (49) and South African Victor Johannes Allers (43), has been named as a criminal suspect Bali Police and taken into custody by Police on Musa Penida Island.

The ill-fated boar left Jungbatu Beach at Nusa Lembongan with two paying passengers on an excursion to view the shores of Nusa Lembongan. When the boat idled near Devil’s Tear – a famous promontory on Nusa Lembongan, it was hit by a 3-meter wave and capsized sending the Indonesian Captain and his two passengers into the sea.

The 35-year-old Captain, Suhadak swam to safety, but the two foreign tourists drowned.

After an almost two-month review of the case, Police determined the Captain acted negligently and have charged him in the death of the South African and Brazilian. Police say the Captain operated his boat in an unsafe manner and also failed to require his passengers to wear life jackets. He has been charge under Section 323 Paragraphs 1 and 4 of Law Number 17 of 2008 and Section 359 of the Criminal Code (KUHP).

Police will now complete the evidence file in the case before handing the matter to State Prosecutors for trial.
